L’intuitionnisme moral et le critère de la subordination juridique devant la Cour de cassation française
Abstract : This paper shows the relations between legal and moral philosophy’s french « Cour de cassation. His judicial review of the labour relation is founded on « moral intuitionism ». These moral intuitions are expressed by Bergson’s flowing concepts. Legal subordination is a good example of such categories determined with signs. To realize social equity, judges enforce the social protection when employee is dependent on employer. The criterion is legal subordination. This legal concept is so soft that judges can suit a moral legality to real situations. In modern society, legal subordination is used to share the labour area and privacy.
